Short Sale Tax Relief Extended For One Year!

Great News For Homeowners in Scripps Ranch, Stonebridge and San Diego County!  When Congress approved "The Fiscal Cliff" tax deal,  a number of tax provisions that benefit current homeowners were continued.

The Mortgage Debt Forgiveness Act of 2007 has been extended for one more year. According to the National Association of Realtors, "the bill would extend mortgage cancellation relief for home owners or sellers who have a portion of their mortgage debt forgiven by their lender, typically in a short sale or foreclosure sale for sellers and in a modification for owners. Without the extension, any debt forgiven would be taxable, which, for underwater households, represents a financial burden."

The National Association of Realtors also stated "The exclusion from taxes for gains on the sale of a principal residence of up to $500,000 ($250,000 for individuals) remains in effect. Only home sellers whose income is $450,000 or above and the gain on the sale of their house is above $500,000 would pay taxes on the excess capital gains at the higher rate (with corresponding numbers for individual filers). For the vast majority of home sellers, there is no change."

The  extension of The Mortgage Debt forgiveness Act of 2007 is seen as vital to the recovering housing market in San Diego and nationwide.  Short Sales in San Diego County ,Scripps Ranch, and Stonebridge Estates had been surging in anticipation of the end of the mortgage cancellation relief on December 31, 2012. The Mortgage Debt Forgiveness Act will now expire on December 31, 2013.

Inovations Academy: A new Scripps Ranch School

Owners of Scripps Ranch homes and their children have always enjoyed access to highly rated Scripps Ranch Public Schools and excellent private schools.  Now they have a third option, Inovations Academy: A Community Charter School. The new school is located on the corner of Scripps Poway Parkway and Spring Canyon Road.

Inovations Academy is a tax payer supported alternative school, serving K - 8 students in Scripps Ranch and all of San Diego City.  It is a constructivist, project based learning school with a strong character and community development program. Inspired by the ideas of French psychologist Jean Piaget, the Constructivist Educational Philosophy is based on the theory "that students generate knowledge and meaning from an interaction between their experiences and their ideas." Learning is project based and with a "strong character and community development program."  The school also offers Scripps Ranch families an exciting, additional choice in education, choose from a full time (5 day) model or a 2 and 3 day model for home schooling families.

SHOULD YOU KEEP THE FAMILY HOME AFTER DIVORCE?

 

Splitting up after years of marriage?  The family home is often seen a place of refuge and emotional stability and one party would often like to keep the house. But should you keep the house? More often than not the answer is no, for a variety of reasons.

Property division in divorce is one of the most important decisions.  Unlike issues such as child custody or support, property division is almost always final and cannot later be undone.  Decisions need to be made before the divorce is final. In making these decisions the divorcing spouses must consider the following items:

  1. What is the true value of the home now and in the foreseeable future?  There is a lot more involved than just the appraisal minus the mortgage. What is the true condition of the home? Any other liens?
  2. The costs of continuing home ownership may be greater than it seems at first. Maintenance costs and taxes can skyrocket.  The home may decrease or increase in value. Future costs of selling the home may not be allowed by the court.
  3. Keeping the home can be risky if there is co-ownership or even just both names on the mortgage.  Even if the title to the property is transferred, both parties remain liable for the mortgage and other liens placed against the property. This can adversely affect either person's credit.
  4. It may be impossible for either party to get a new mortgage either to refinance the existing property or to purchase a new home.

In deciding whether to keep the family home the divorcing parties need to protect themselves in this adversarial situation.  To protect your self you need a good lawyer, a good accountant or financial planner, and a real estate agent specially trained to handle the sale of real estate during or after a divorce.
